Best Practices vs Illegal

A major difficulty employers face is that they can really do as they like regarding employment law compliance. It is not illegal to have an employee and no employment agreement in place (although we do say it is). But best practice demands one does.

The heart of the problem is of course while employers can do as they choose – or choose to do nothing - unless they comply, there is no defence if and when things go pear-shaped.

Things go 'Pear - Shaped' about 35 times a day according to our incoming calls and in about 25 cases - there is no solid defence. This means we might struggle to even find mitigating circumstances.
