RECOVERY OF MONIES
Overpayment of wages was claimed by the applicant. There was no appearance by the respondent. An administrative error meant that the respondent was paid his salary for two months after his employment ended. The respondent had not disputed liability and indicated on a number of occasions that he had arranged to pay the money back by installments. However, no payments had ever been received. The applicant did not attend when parties were formally directed to mediation. The respondent had embarked on a series of delaying tactics which could not continue. The Authority ordered the respondent to repay the money by installments. It also ordered if the respondent defaulted on any payment, applicant was entitled to interest at 8 percent on the outstanding balance and could elect to treat the entire amount as due and payable immediately. |
