The Holidays Act 2003 introduced the requirement for employers to provide employees with a minimum of four weeks paid annual holidays for each 12 months employment alongside a requirement to calculate their annual holiday pay for those holidays in a particular manner.
Employers are not permitted to pay “basic” pay during holidays – and the employer must carry out two calculations on each occasion that annual holidays are paid to ensure compliance with the Act.
